7stamp Terms of Use
Including White Label Schedule and Data Processing Addendum
These Terms of Use ("Terms") constitute a binding legal agreement between PayForSay s.r.o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Dolezalova 3424/15C, 821 04 Bratislava - Ruzinov, Slovakia, Business ID (ICO): 54455073, Tax ID (DIC): 2121683322, VAT ID: SK2121683322 ("Company", "PayForSay", "7stamp", "we", "us", or "our"), and the person or entity accessing or using the 7stamp services ("User", "Merchant", "White Label Partner", "Managed Business", "End User", or "you").
By creating an account, purchasing or activating a plan, enabling White Label, activating an Access Code, registering as a Managed Business, joining a loyalty card, or otherwise accessing the Service, you agree to these Terms. If you act for a business entity, you represent that you are authorized to bind that entity.
1. Service
7stamp is a SaaS platform for digital loyalty cards, digital stamp cards, rewards, vouchers, Apple Wallet and Google Wallet cards, scanner workflows, email and wallet/card notifications, integrations, Access Codes, and related loyalty-program tools.
2. Definitions

| Managed Business | A business onboarded, supported, billed, or managed by a White Label Partner under the partner's brand. |
| Program Operator | The entity that actually operates a loyalty program and determines its reward rules, campaign audiences, redemption conditions, and customer relationship. This may be the Merchant, the White Label Partner, or the Managed Business depending on the setup. |
| Partner Legal Texts | The partner's own Terms of Use, Privacy Policy, Refund/Cancellation Policy, loyalty program rules, consent wording, cookie disclosures, and other customer-facing legal materials. |
| Access Code | A prepaid code that activates one or more Packages or White Label access. Access Codes take priority over the base tariff plan and are locked to a business after activation. |
| Package | A 7stamp service unit for one location or Staff Login, with the usage limits and functionality described in the plan, Access Code, or partner agreement. |
| White Label Service Domains | Partner-branded domains or subdomains used for the admin panel, customer card page, scanner, or other service interfaces. |
3. Eligibility and Accounts
- You must be at least 16 years old, or the minimum age required by applicable law, to use the Service as an End User.
- Business accounts must be created by persons authorized to act for the relevant business.
- You must provide accurate account, billing, tax, support, and business information and keep it current.
- You are responsible for all activities under your account, including actions by staff, contractors, agencies, or administrators.
4. License and Intellectual Property
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your permitted business or personal use. We retain all rights in the Service, software, APIs, platform, templates, documentation, databases, designs, and technology.
You grant us a limited license to use logos, images, text, trademarks, brand assets, reward descriptions, and other content you provide solely to operate, display, secure, support, and improve the Service, including to generate digital loyalty cards and related materials.
5. Plans, Fees, Access Codes, and Billing
- Direct 7stamp purchases may be processed by 7stamp, Paddle, Stripe, or another expressly identified merchant of record or payment processor.
- Where the checkout or invoice identifies Paddle as merchant of record, the payment contract is with Paddle and Paddle's terms apply to payment processing.
- Where a White Label Partner uses its own Stripe, payment account, checkout, invoice, or merchant account to charge a Managed Business, the White Label Partner is the seller and payment merchant for those charges unless the checkout expressly names another merchant of record.
- Access Codes take priority over the base tariff plan. Access Code resources are consumed first and reset according to the applicable code rules. Lifetime Access Codes do not mean unlimited usage.
- Access Codes and Packages may be locked to the business after activation and may be non-transferable unless the applicable offer expressly says otherwise.
6. Refunds, Cancellations, Taxes, and Chargebacks
Refunds and cancellations for direct 7stamp purchases are governed by our Refund Policy and the terms of the merchant of record identified at checkout. Refunds and cancellations for partner-billed Managed Business purchases are governed by the White Label Partner's own refund and cancellation terms, unless the checkout or receipt expressly identifies 7stamp, Paddle, or another provider as seller or merchant of record.
White Label Partners are solely responsible for their own pricing disclosures, billing notices, taxes, VAT or sales-tax treatment, refunds, cancellations, chargebacks, auto-renewal notices, consumer notices if applicable, and local-law compliance in partner-managed payment flows.
7. Acceptable Use
- Do not use the Service for illegal goods, unlawful services, fraud, deception, spam, malware, phishing, adult sexual services, weapons, tobacco, controlled substances, or content that violates Apple Wallet or Google Wallet policies.
- Do not reverse engineer, decompile, scrape, overload, interfere with, or bypass limits of the Service.
- Do not send marketing communications without a valid legal basis and required consent.
- Do not upload content that infringes third-party rights or misleads End Users about rewards, prices, expiry, eligibility, or redemption.
8. Customer Communications and Consent
7stamp currently supports two End User communication channels: wallet/card notifications displayed through Apple Wallet or Google Wallet, and email messages. Marketing communications are separate from transactional loyalty communications.
- Marketing communications include promotions, special offers, win-back campaigns, birthday offers, personalized offers, and commercial campaigns. They require a separate optional consent where required by law.
- Transactional loyalty communications include stamp updates, issued rewards, issued vouchers, voucher status, expiry reminders, card-related service information, and important loyalty program notices.
- Acceptance of Terms or Privacy Policy is separate from optional marketing consent. Refusing or withdrawing marketing consent must not prevent the End User from receiving and using a loyalty card, stamps, vouchers, or rewards.
- End Users can manage email preferences through unsubscribe and communication-preference links. Wallet/card notifications are managed in Apple Wallet or Google Wallet settings.
- Important account, security, legal, billing, or service notices may still be sent where necessary to provide the Service, maintain security, or comply with legal obligations.
9. White Label Schedule
This White Label Schedule applies automatically when a business purchases, enables, activates, or uses White Label features, White Label Access Codes, partner-branded domains, partner-branded emails, partner-branded legal texts, or partner-managed Managed Business onboarding.
9.1 White Label scope
- White Label may include partner-branded admin panel, customer card page, scanner, logos, colors, emails, support contacts, printed materials, and Partner Legal Texts.
- White Label applies to the account or enabled configuration, not automatically to every Package unless the applicable plan or Access Code says so.
- Managed Businesses may not see standard 7stamp tariffs where the White Label Partner controls their subscription through Access Codes or partner-managed billing.
9.2 Role allocation by scenario

9.3 Partner Legal Texts and responsibility
The White Label Partner is solely responsible for reviewing, adapting, completing, publishing, and maintaining its own Partner Legal Texts, including Terms of Use, Privacy Policy, Refund/Cancellation Policy, loyalty program rules, consent wording, cookie disclosures, business details, pricing, tax information, refund rules, support details, and local-law notices.
Templates, examples, default legal texts, implementation notes, and sample clauses provided by 7stamp are for convenience only, do not constitute legal advice, and are not a substitute for review by the partner's own qualified legal counsel. 7stamp does not guarantee that any template is suitable for the White Label Partner's jurisdiction, business model, customer type, industry, tracking configuration, payment flow, or legal obligations.
7stamp has no obligation to review, validate, approve, monitor, or correct Partner Legal Texts or partner customer communications. The White Label Partner remains responsible even if it used a 7stamp template or example wording.
9.4 Partner indemnity
The White Label Partner shall indemnify, defend, and hold harmless PayForSay s.r.o., its officers, employees, contractors, and affiliates from and against any claims, complaints, investigations, fines, penalties, losses, damages, chargebacks, refunds, costs, and expenses, including reasonable legal fees, arising out of or related to inaccurate, incomplete, outdated, unlawful, misleading, or missing Partner Legal Texts, consent wording, cookie or tracking disclosures, pricing, tax disclosures, refund or cancellation terms, support information, customer communications, marketing campaigns, partner-enabled tracking tools, or partner-managed billing flows.
9.5 Custom-domain tracking
By default, White Label Service Domains use only cookies and similar technologies that are strictly necessary to provide the Service, authenticate users, maintain sessions, prevent fraud, secure the platform, remember essential preferences, and operate the loyalty card and admin/scanner workflows, unless optional analytics, advertising, or similar tracking is separately enabled through a supported configuration.
The White Label Partner is solely responsible for determining whether partner-enabled optional analytics, advertising, pixels, tags, SDKs, or similar tools are lawful in each jurisdiction, obtaining any required consent before such optional tools operate, honoring opt-outs, maintaining accurate cookie/pixel disclosures, and keeping a provider inventory for partner-enabled tools. PayForSay s.r.o. may disable or refuse tracking configurations that appear non-compliant or create material legal, security, platform, or reputational risk.
10. Third-Party Services
The Service may interoperate with Apple Wallet, Google Wallet, payment processors, cloud hosting, analytics, email providers, domain providers, and partner-enabled integrations. We are not responsible for third-party services outside our control, and their own terms and policies may apply.
11. Disclaimer of Warranties
THE SERVICE, TEMPLATES, DOCUMENTATION, EXAMPLES, ACCESS CODES, APIs, AND WHITE LABEL FEATURES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND LEGAL SUITABILITY OF TEMPLATES OR PARTNER CONFIGURATIONS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR FREE USERS, LIABILITY IS LIMITED TO EUR 50. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY DAMAGES, LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
13. Data Processing Addendum
Where 7stamp processes personal data on behalf of a Merchant, White Label Partner, or Managed Business as a processor, Appendix A applies and is incorporated into these Terms. If a separate signed data processing agreement exists, that separate agreement controls in case of conflict.
14. Governing Law and Disputes
These Terms are governed by the laws of the Slovak Republic, without regard to conflict-of-law rules. Unless mandatory law requires otherwise, the courts of Bratislava, Slovakia have jurisdiction over disputes arising from these Terms. Consumers may have mandatory rights in their country of residence that cannot be waived by contract.
15. Changes
We may update these Terms from time to time. Material changes will be notified through the Service, website, email, or other reasonable means. Continued use of the Service after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

Appendix A: Data Processing Addendum
This Data Processing Addendum (DPA) applies where PayForSay s.r.o. processes personal data on behalf of a Merchant, White Label Partner, or Managed Business as processor. The controller is the entity that determines the purposes and essential means of the relevant processing.
A1. Subject matter and duration
The subject matter is the provision of the 7stamp loyalty platform, including card issuance, stamp and voucher operations, scanner workflows, email and wallet/card notifications, analytics necessary to operate the service, integrations, support, and security. Processing continues for the term of the account, plan, Access Code, White Label configuration, or other agreement, and for any retention period required for security, legal, accounting, or dispute purposes.
A2. Nature and purpose of processing
- Creating and managing digital loyalty cards, stamps, vouchers, rewards, and redemptions.
- Sending transactional loyalty communications and, where valid consent exists, marketing communications through supported channels.
- Providing admin, scanner, customer-card, support, security, logging, and integration functionality.
- Maintaining platform integrity, fraud prevention, abuse detection, backups, and audit records.
A3. Categories of data subjects and personal data

A4. Processor obligations
- Process personal data only on documented instructions of the controller, including these Terms, the configuration of the Service, and lawful instructions given through the account or API.
- Ensure that persons authorized to process personal data are bound by confidentiality obligations.
- Implement appropriate technical and organizational measures taking into account the state of the art, costs, nature, scope, context, and risks of processing.
- Assist the controller, taking into account the nature of processing, with data-subject requests, security obligations, data protection impact assessments, and regulator consultation where required.
- Notify the controller without undue delay after becoming aware of a personal data breach affecting controller personal data.
- Delete or return personal data after termination as required by the controller, unless retention is required by law or justified for security, dispute, accounting, backup, or legitimate compliance purposes.
- Make available information reasonably necessary to demonstrate compliance with processor obligations, subject to confidentiality, security, and reasonable audit procedures.
A5. Sub-processors
The controller authorizes 7stamp to use sub-processors necessary to provide the Service, including cloud hosting, authentication, database, email delivery, error logging, analytics necessary for service operation, payment, and support providers. 7stamp will impose data protection obligations on sub-processors that are materially equivalent to those in this DPA. The current sub-processor categories may be listed in the Privacy Policy or sub-processor page if published.
A6. International transfers
Where personal data is transferred outside the EEA, UK, or Switzerland, 7stamp will use a lawful transfer mechanism, such as an adequacy decision, EU Standard Contractual Clauses, UK transfer mechanism, Data Privacy Framework certification where applicable, or another lawful safeguard.
A7. California service provider / contractor terms
Where the controller is a business subject to the California Consumer Privacy Act / California Privacy Rights Act and discloses personal information to 7stamp for a business purpose, the parties intend 7stamp to act as a service provider or contractor, as applicable, for the personal information processed on the controller's behalf. In that capacity, 7stamp will not sell or share such personal information, retain, use, or disclose it outside the direct business relationship except as permitted by applicable law, combine it with personal information from other sources except as permitted by applicable law, or use it for cross-context behavioral advertising. 7stamp will assist the controller with applicable consumer requests to the extent required by law and feasible through the Service.
A8. Conflicts
If this DPA conflicts with the main Terms, this DPA controls for processor obligations. If a separately signed DPA or data processing agreement exists, the separately signed agreement controls over this Appendix.
